Discrimination

Being the victim of discrimination or a civil rights violation is humiliting and demoralizing, especialy when such discrimination occurs in the workplace. No one should have to suffer the indignity of being discriminated against simply because of the way they look, their religious beliefs, their gender, their age, a disability or any other inappropriate and illegal reason. At T.J. Minimum Wage

​The New York minimum hourly wage is $7.25 an hour. Under the New York law, this is generally the lowest wage employers are allowed to pay their employees. Unfortunately, some employers do not follow this law and pay their New York employees much less than they are owed. At T.J. Piotrowski, we represent workers who were not paid the wages they earned.  

 

Sexual Harassment

 

Sexual harassment is a form of gender discrimination that is prohibited by Title VII of the Civil Rights Act of 1964. Sexual harassment is demoralizing and demeaning. At T.J. Piotrowski, we are fiercely committed to assisting victims of sexual harassment achieve dignity in the workplace through forceful and aggressive representation. Overtime

The Fair Labor Standards Act (FLSA) governs an employer’s duty, and an employee’s right to receive fair wages. With some exceptions, if you have worked over 40 hours in any given week, your employer should have paid you your regular rate of pay for the first 40 hours and 1.5 times your regular rate of pay for each hour after 40. For most people, this is true no matter what your job title is, how you are paid (i.e. hourly, salary, by commission, by job completed) or what your employer may have told you about overtime. It is a fundamental principle of law that an employee should be paid fairly for the work he or she has done for an employer. We help employees who may have been illegally denied their right to fair compensation. If you have not been paid the fair wages to which you were entitled, you can recover the wages you should have been paid plus what is called liquidated damages, which are typically an additional amount equal to the wages you were owed. For instance, if you were entitled to $1,500 in overtime wages that your employer did not pay you, you may be able to obtain that amount plus an additional $1,500 for your wage and hour/overtime claim for total of $3,000. The law also allows you to recover the costs of your lawsuit and your attorney's fees so the case does not cost you anything because your employer has to pay all of the fees and costs.

Retaliation

Retaliation by an employer against an employee who either (1) complains about discrimination, (2) partcipates in an investigation or (3) opposes discrimination practices is illegal and can provide the retaliated-against employee a basis to sue.
